There is a misconception among a lot of employers in New Jersey that they have to engage in progressive discipline with employees, and this is false. Unless you have a company policy that requires you to engage in progressive discipline, there’s no legal requirement that you do that in the private sector. If somebody’s behavior is such that you’re better off without that person, you can let them go without engaging in the multiple steps leading up to termination.
