There are occasions when we encounter an employee who’s complaining about a supervisor who’s off-track in every direction. The supervisor will make comments based on race, ethnic background, religion, gender, sexual preference, and seems to have no bottomless pit of vile things to say. This is inappropriate behavior in the workplace, and the employee needs to report it to upper management if there’s a mechanism to do so. Otherwise, the employee can take legal action against the employer for permitting a hostile work environment to exist. These are fact-based scenarios, and we have to make sure that the employee understands that she has the burden of proving that the workplace is so bad that no reasonable person would withstand it.
