Every now and then we’ll get a call from a pregnant woman who’s concerned that once her boss finds out, he’ll lay her off. We rush to assure her that pregnancy is a protected class in New Jersey. Essentially, it’s a form of gender discrimination, and her employer cannot let her go, demote her, transfer her, or fire her just because she’s pregnant. Now there may come a point where she’s no longer able to do the job because of her pregnancy, and it could be either because she has a complication or because she’s just so far along she can’t work anymore. That’s a different issue entirely. She is protected from any kind of adverse job action, just on the basis of her pregnancy alone.
